Orders for possession (residential & commercial property and land)
As High Court Enforcement Officers, The Sheriffs Office is duly authorised to execute orders for possession of residential and commercial property or land.
For the repossession of commercial property or land, we will transfer your order to the High Court (if necessary) to obtain a Writ of Possession.
For the repossession of residential property, when applying for your order for possession from the County Court you will need to make an application under Section 42 of the County Courts Act 1984 to transfer enforcement to the High Court. Further information can be found in our related article.
Once we have your instruction, our experienced team of High Court Enforcement Officers operates nationwide and offers a quick and professional response to even the most complicate of repossessions.
All Enforcement Officers have an active support network of locksmiths, tow trucks, removal teams, glaziers and security services. Should it be required, we will also enlist Police support to prevent a breach of the peace.
We will liaise with you personally, discussing the quickest and most effective way to reclaim the property or land that is rightfully yours.
Eviction under Common Law (commercial property or land)
Our Enforcement Officers can evict trespassers, travellers and squatters from commercial land or property under The Criminal Justice and Public Order Act 1994. We will serve eviction notices giving them a maximum of 24 hours to vacate the site and will return the following day to ensure they have left.
If they remain, our Enforcement Officers, along with removal vehicles, tow trucks and the Police, if necessary, will remove them, restoring the land back to its rightful owner.
